  1. Deposits and Payments-Scheduled Cruises We require a 20% deposit to confirm your booking, then full payment 1 week before your departure. This deposit is fully refundable up until 30 days prior to departure then no refund will be made unless we can full your place/s. We will provide all bank details for swift and easy transfer of funds.  Please ensure you clearly identify your funds transfer.

    Namaste Cruises requires you secure complete travel insurance coverage. We will require evidence of adequate cover prior to your cruise.
  2. Cuisine
    All meals served on board are prepared to high standards, combining both local and western dishes, with a selection of fresh tropical fruits and vegetables. Any special meal requests or dietary requirements must be made at the time of booking.
  3. Not Included
    Air transfers, taxes and hotel accommodations unless stated. Drinks or refreshments other than those specified, laundry services, personal and baggage insurance, other items of a personal nature, and all taxes.
  4. Itinerary
    Cruise itineraries are always subject to change due to weather or safety conditions.

 


 

Namaste Cruises: Charter Cruises and Conditions

      (Payable 14 days following confirmation of booking.)
    • Final Payment: 30 Days prior to departure.
    • Refund of 50%, between confirmation and 60 days prior to departure.
    • No refund, 59 days prior to departure.

Because some ports have excessive port charges, harbor fees and landing fees are not covered in the basic charge rate.

Namaste Cruises: General Terms and Conditions

  1. By using the website you agree that you have read and agree with the terms of the Namaste Cruises Website Disclaimer and Privacy Statement.
  2. Namaste Cruises operates cruises in the open ocean and on busy waterways and are subject to the risks and perils of cruising in the open ocean and on such waterways including loss, damage and injury arising out of or in connection with changing tidal and weather conditions and the navigation of other craft. To the extent permissible by law, Namaste Cruises and any agent acting on our behalf will not be responsible in tort, contract or otherwise for any loss or damage arising out of injury or death sustained by you or any other passenger, howsoever arising and whether or not arising as a result of our negligence or failure to render due care and skill. You enter into this agreement and book and travel on our cruises at your own risk. If however any guarantees, terms, conditions or warranties are implied into this agreement by any law of the Republic of Indonesia or any other relevant legislation, the exclusion of which would contravene that law or cause part or all of this clause to be void, then to the extent permissible by law:

(a) We exclude all other guarantees, terms, conditions and warranties; and

(b) Our liability for breach of such guarantee, term, condition or warranty is limited to the supply of the relevant cruise again or the cost of re-supplying the cruise.
We exclude all liability for any loss or damage to clothing or personal items/belongings howsoever arising and whether or not our liability arises in tort, contract or otherwise.

  1. Where we offer diving, snorkelling and other activities, you acknowledge that these activities carry certain inherent risks which you assume. Certain medical conditions and medications may preclude you from snorkelling or diving. For advice contact the Tour Operator or designated staff on the vessel. The minimum age for diving is 12 years. Persons under 18 years will need permission from a parent or guardian. You need to wait 12 hours after a single dive, or 24 hours after multiple dives, before ascending to an altitude of 300 metres or greater (for example, flying). Snorkelling can be a strenuous activity. You must use caution and inform designated staff on the vessel of any medical conditions. In consideration for the diving, snorkelling and other activities being provided to you, you release, discharge, waive and relinquish any and all claims, suits, actions, causes of actions or the like against Namaste Cruises and any associated Tour Operator and our servants or agents in respect of any loss or damage suffered by you as a result of the diving, snorkelling or other activities, or for any loss or damage to you or your property sustained during the activity or otherwise in connection with it, including but not limiting to loss or damage suffered during or as a result of you engaging in the activities whether such loss or damage was caused or contributed to by any equipment supplied or serviced by us, our servants or agents and whether loss or injury was caused or contributed to by any negligence or breach of duty by us or our servants or agents or otherwise.
  2. Given the risks involved in this Tour (including the risks mentioned above) you must obey our staff’s instructions at all times.
  3. Exclusion of Liability.
    Namaste Cruises may acts as agent for Tour Operators when making arrangements for your Tour. Where Namaste Cruises provides services it will do so with due care and skill. Namaste Cruises is not responsible for the acts and omissions of others, including Tour Operators and their staff for any loss, damage, death, injury or expense (including loss of money paid in advance), which you may incur as a consequence of the acts and omissions of others. You warrant that you have not relied on any representation made by Namaste Cruises, or other representative, which has not been stated expressly on this Website.Namaste Cruises will not accept responsibility or liability if you contravene any law or regulation. Any independent arrangements that you make that are not part of the Tour offered by Namaste Cruises (including pre and post accommodation) are entirely at your own risk and Namaste Cruises cannot and does not give you any assurance, representation or warranty in connection with any such arrangements.To the fullest extent permitted by law and subject to the exception set out below, Namaste Cruises does not accept liability for any loss, death, injury or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with or arising from your participation in a Cruise, or in respect of a failure or omission on the part of Namaste Cruises to comply with its obligations as a tour agent. To the fullest extent permitted by law and subject to the exception set out below, you also agree to release Namaste Cruises and its officers, employees, agents and representatives (“Representatives) from all costs, liability, loss and damage incurred by you in connection with your participation in any cruise, and waive any associated claims that you may have against Namaste Cruises or its Representatives as a result of your participation in any Cruise. For these purposes, Namaste Cruises enters into these Booking Conditions as trustee or agent for its Representatives.To the fullest extent permitted by law and subject to the exception set out below, any condition or warranty, which would otherwise be implied into these Booking Conditions is excluded. Where legislation implies any condition or warranty, and that legislation prohibits us from excluding or modifying the application of, or our liability under, any such condition or warranty, that condition or warranty will be deemed included but our liability will be limited for a breach of that condition or warranty to one or more of the following:(a) if the breach relates to goods:
    (i) the replacement of the goods or the supply of equivalent goods;
    (ii) the repair of such goods;
    (iii) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
    (iv) the payment of the cost of having the goods repaired; and(b) if the breach relates to services:
    (i) the supplying of the services again; or
    (ii) the payment of the cost of having the services supplied again.Exception
    The “Exclusion of Liability section set out in these Booking Conditions does not attempt or purport to exclude, restrict or modify liability arising under, or remedies that may be available to you, pursuant to legislation where the exclusion, restriction or modification of liability or remedies is not permitted. This includes all relevant legislation.
  4. Cancellation by You
    If you wish to cancel all or any part of your booking, notification of cancellation must be made according to the requirements as outlined above. Your deposit will be refunded in full if you give the required notice. Your deposit will be forfeited if you fail to give notice required by the clauses above or you do not take the cruise without the required notice.
  5. Travel Insurance
    Adequate and valid travel insurance is compulsory for all persons who book cruises with Namaste Cruises. We recommend that your travel insurance covers accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. We also recommend it covers cancellation, curtailment and loss of luggage and personal effects. We require policy details prior to your departure and reserve the right to refuse carriage should you not have adequate insurance. Your insurance policy should cover such activities as diving if you are planning to dive.
  6. Health, Fitness, Tour Grades and Age Limits
    It is your responsibility to advise the Namaste Cruises of any pre-existing medical condition and/or disability that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a tour and the enjoyment of other tour members. If requested by Namaste Cruises, or our suppliers, you may be required to provide an assessment of your medical condition by completing a special Health & Fitness Questionnaire and/or a Medical Clearance Form, the latter which requires certification by a medical practitioner. Namaste Cruises also reserves the right to cancel your participation in a cruise at any time, including after the commencement of your cruise, with no right of refund if your medical condition and/or disability could be reasonably expected to affect the normal conduct of the cruise and the enjoyment of other cruise members.
